商務(wù)英語法律文獻(xiàn)翻譯的“直譯”與“意譯”

以上譯文從整個篇章的結(jié)構(gòu)來看,主要是直譯,譯文中的句子結(jié)構(gòu)基本上與原文一致,只不過有些修飾成分的位置做了適當(dāng)?shù)恼{(diào)整。如:according to...短語在原文中是在后面,但是,在譯文中,根據(jù)漢語的習(xí)慣,其譯文放在前面。This Convention shall apply:翻譯成“本公約適用于:”可以說是典型的直譯。句子結(jié)構(gòu)排列完全一致。

法律文獻(xiàn)語言嚴(yán)謹(jǐn),不追求風(fēng)格的形式優(yōu)美,也沒有字里行間的蘊(yùn)意。為了追求語言的確鑿、準(zhǔn)確、嚴(yán)密,有時(shí)在翻譯時(shí)即使調(diào)整語言結(jié)構(gòu),也盡量不要讓句子過于支離破碎。哪怕譯文讀上去不是那么十分流暢,寧愿犧牲一點(diǎn)流暢也要保持意思的確鑿。例如:

The Owners only to be responsible for delay in delivery of the vessel or for delay during the currency of the Charter and for loss or damage to goods onboard, if such delay or loss has been caused by want of due diligence on the part of Owners or their Manager in making the vessel seaworthy and fitted for the voyage or any other personal act or omission or default of the Owners or their Manager.

船舶所有人僅對由于船舶所有人或他的經(jīng)理人沒有盡到謹(jǐn)慎處理使船舶適航或適于航次,或因船舶所有人或他的經(jīng)理人的個人行為、或疏忽、或過失所造成的交船延誤、或合同期間的延遲交付貨物和船上貨物的滅失和損壞負(fù)責(zé)。


以上的譯文可以說基本上是直譯,因?yàn)樽g文的句子與原文的句子排列上大致相同,句子中間有些詞語作了局部調(diào)整譯文句子基本結(jié)構(gòu)是:“船舶所有人僅對……負(fù)責(zé)”,“對”后面的成分很長,讀起來有些費(fèi)力,但是,這是法律英語的特點(diǎn)之一,翻譯成漢語時(shí)拆分結(jié)構(gòu)會影響意義時(shí),就要照顧到這種語言結(jié)構(gòu),以免產(chǎn)生誤解。再例如:

In the event of dry-docking or other necessary measures to maintain the efficiency of the Vessel, deficiency of men or Owners' stores, breakdown of machinery, damage to hull or other accident, either hindering or preventing the working of the vessel and continuing for more than twenty-four consecutive hours, no hire to be paid in respect of any time loss thereby during the period in which the Vessel is unable to perform the service immediately required. Any hire paid in advance to be adjusted accordingly.
