兩者的區(qū)別在于invitee ( “被邀請人”)是指經(jīng)明示或默示邀請而到他人住處者,其前往他人住處之目的與邀請人的商事事務(wù)直接或間接相關(guān);該地方的占有人(occupier)必須對被邀請人的安全保護(hù)負(fù)責(zé)[1]。guest ( “客人”)則指付費(fèi)在旅店等住宿者;或在某人家中受款待者;或免費(fèi)搭乘汽車者[2]。從法律的角度講,a guest (“客人”)是一位licensee (被特許人)而非 invitee (被邀請人)。如僅到旅店(inn)就餐者而不住宿者便只能算作“顧客”(customer〉,顧客可以算作invitee,但卻非(客人)guest (請參閱條目 social guest)。
