兩者的區(qū)別在于invitee ( “被邀請人”）是指經(jīng)明示或默示邀請而到他人住處者，其前往他人住處之目的與邀請人的商事事務(wù)直接或間接相關(guān)；該地方的占有人（occupier)必須對被邀請人的安全保護(hù)負(fù)責(zé)[1]。guest ( “客人”）則指付費(fèi)在旅店等住宿者；或在某人家中受款待者；或免費(fèi)搭乘汽車者[2]。從法律的角度講，a guest (“客人”）是一位licensee (被特許人）而非 invitee (被邀請人）。如僅到旅店（inn)就餐者而不住宿者便只能算作“顧客”（customer〉，顧客可以算作invitee，但卻非（客人）guest (請參閱條目 social guest)。
