Brand, Trademark 和 Trade name法律術(shù)語分析

以上術(shù)語均用作指商業(yè)、商品或服務(wù)的名稱,但它們并非同義(盡管有些人把它們都當(dāng)作“商標(biāo)”)。差異在于brand (“品牌”)主要指已經(jīng)樹立的,經(jīng)常是著名的且用于廣告的商品名稱,其不是正式的法律術(shù)語,一般不具備法律上的排他權(quán)[1]。brand mark或brand name為“商品商標(biāo)”,常指同一企業(yè)生產(chǎn)或銷售的一系列產(chǎn)品或提供的服務(wù)的名稱,如“長虹”便是 the brand name of a line of household appliances。與 brand 相比較,trademark (商標(biāo))為典型的法律術(shù)語,表示經(jīng)登記注冊之商標(biāo),具有排他權(quán),未經(jīng)同意使用則構(gòu)成侵權(quán),其可以是詞語、符號等,為制造商或商人所采用以將自己的商品與他人的商品加以區(qū)別[2]。tradename (商號)是指用于區(qū)分業(yè)務(wù)或職業(yè)的名字或標(biāo)記,有時也可當(dāng)作商標(biāo)使用,與trademark—樣,其也受到法律的保護(hù),其多用于表示經(jīng)營某種業(yè)務(wù)的公司、企業(yè)、團(tuán)體等實(shí)體的名稱的區(qū)分等[3]。
