兩者均有三人或三人以上非法集會以滋事的含義。它們的區(qū)別在于rout源于route，指非法集會者“on their way”，故其不一定實際實施了其旨在的犯罪，且其行進的方式也并非是 “tumultuous manner"[1]，因而不宜像有些詞典那樣將其視為riot而譯為“聚眾鬧事罪”或“騷擾罪”[2]，實際上該單詞應(yīng)為“聚眾前往鬧事罪”。riot則指三人或多人非法集會以暴力威脅或恐嚇公眾之方式破壞治安，故為“聚眾騷亂罪”或“暴亂罪”，按普通法規(guī)定其為“輕罪”（misdemeanor) [3]。根據(jù)1714年通過的制定法，即Riot Act，凡12人以上不法集會擾亂治安，警告后仍聚集一小時以上者則可視為是重罪“felony”，可處以終身監(jiān)禁（在剛通過該法時，其是capital offense)[4]。
